1. Introduction

Welcome to PharmaDiagrams. These Terms and Conditions ("Terms") govern your use of the PharmaDiagrams website at www.pharmadiagrams.com and application at app.pharmadiagrams.com (collectively, the "Service"), operated by Bartlomiej Baran Ventures Limited, a company registered in Dublin, Ireland ("we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

2. Description of Service

PharmaDiagrams is a free online process flow diagram (PFD) editor designed for pharmaceutical manufacturing teams. The Service provides:

• High-level process flow visualization tools
• Native pharma industry symbols (ISA-5.1/P&ID)
• Data tables for process documentation
• Check-in/check-out editing workflows
• Review and approval workflows
• Part 11 audit trails (Enterprise tier)

Important: PharmaDiagrams is a high-level process flow visualization tool. It is NOT a replacement for detailed P&ID engineering tools such as AutoCAD P&ID or SmartPlant P&ID. Users should use appropriate specialized tools for detailed engineering work.

3. Account Registration

To use certain features of the Service, you must register for an account by providing your email address and name. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

4. Service Tiers

PharmaDiagrams offers the following service tiers:

• Free Tier - Available for freelancers and small teams with core diagram editing features
• Enterprise Tier - Paid tier with additional collaboration, sharing, and compliance features including Part 11 audit trails

We reserve the right to modify the features available in each tier at any time with reasonable notice.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the Service in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Upload or transmit malicious code or harmful content
• Use the Service to infringe on intellectual property rights of others
• Resell or redistribute the Service without authorization
• Use automated systems to access the Service without permission

6. Intellectual Property

Our intellectual property: The Service, including its design, features, and content (excluding user-generated content), is owned by Bartlomiej Baran Ventures Limited and is protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.

Your content: You retain ownership of all diagrams, data, and content you create using the Service ("User Content"). By using the Service, you grant us a limited license to store and process your User Content solely for the purpose of providing the Service to you.

You have the right to download or delete your personal data at any time through your dashboard at app.pharmadiagrams.com or by contacting us at contact@pharmadiagrams.com.

Service Monitoring

To provide and improve the Service, we use product analytics and error monitoring tools. These tools help us understand how users interact with features, identify usability issues, and detect and fix bugs. This monitoring is essential for maintaining service quality, security, and reliability.

By using the Service, you acknowledge that we may collect usage data, error reports, and performance metrics as described in our Privacy Policy. We implement data minimization practices and do not use this data for advertising purposes.

8. Disclaimer of Warranties

Engineering disclaimer: PharmaDiagrams is a visualization and documentation tool. All diagrams and documentation created using the Service should be reviewed and validated by qualified engineers before use in production environments. We are not responsible for engineering decisions made based on content created with the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BARTLOMIEJ BARAN VENTURES LIMITED AND ITS DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us (if any) in the twelve (12) months preceding the claim.
